GENERAL:

1. If you place an order electronically through the website you are using, you will be deemed to have accepted the pre-information form and the distance sales contract provided to you.

2. Buyers are subject to the provisions of the Law on Consumer Protection No. 6502 and the Regulation on Distance Contracts (Official Gazette: 27.11.2014/29188) and other applicable laws regarding the sale and delivery of the products they purchase.

3. Shipping costs, which are the product shipping expenses, will be paid by the buyers.

4. Each purchased product is delivered to the person and/or organization at the address indicated by the buyer, provided that it does not exceed the legal period of 30 days. If the product is not delivered within this period, Buyers may terminate the contract.

5. The purchased product must be delivered complete, in accordance with the specifications stated in the order, and with documents such as a warranty certificate and user manual, if any.

6. If the sale of the purchased product becomes impossible, the seller must notify the buyer in writing within 3 days from the date they learn of this situation. The total amount must be refunded to the Buyer within 14 days.

*Due to hygiene rules, earrings cannot be exchanged or returned.

IF THE PURCHASED PRODUCT PRICE IS NOT PAID:

7. If the Buyer does not pay the price of the product purchased or cancels it in the bank records, the Seller's obligation to deliver the product ceases.

PURCHASES MADE WITH UNAUTHORIZED CREDIT CARD USE:

8. If, after the product has been delivered, it is determined that the credit card used by the buyer for payment has been used unlawfully by unauthorized persons, and the price of the sold product is not paid to the Seller by the relevant bank or financial institution, the Buyer must return the product subject to the contract to the SELLER within 3 days, with shipping costs belonging to the SELLER.

IF THE PRODUCT CANNOT BE DELIVERED ON TIME DUE TO UNFORESEEABLE REASONS:

9. If force majeure events that the Seller cannot foresee occur and the product cannot be delivered on time, the Buyer is informed. The Buyer may request cancellation of the order, replacement of the product with a similar one, or postponement of delivery until the obstacle is removed. If the Buyer cancels the order; if the payment was made in cash, this amount is paid back in cash within 14 days from the cancellation. If the Buyer made the payment by credit card and cancels it, the product price is refunded to the bank within 14 days from this cancellation, however, it is possible for the bank to transfer it to the buyer's account within 2-3 weeks.

BUYER'S OBLIGATION TO INSPECT THE PRODUCT:

10. The Buyer will inspect the goods/services subject to the contract before receiving them; they will not accept damaged or defective goods/services such as dents, breaks, torn packaging, etc., from the cargo company. Goods/services received will be deemed to be undamaged and intact. The BUYER is obliged to carefully protect the goods/services after delivery. If the right of withdrawal is to be exercised, the goods/services must not be used. The Invoice must also be returned with the product.

RIGHT OF WITHDRAWAL:

11. The BUYER may exercise their right of withdrawal from the contract by refusing the goods without assuming any legal or criminal liability and without stating any reason, provided that they notify the SELLER through the communication details below, within 14 (fourteen) days from the delivery date of the purchased product to them or to the person/entity at the address they indicated.

DURATION OF THE RIGHT OF WITHDRAWAL:

13. If the purchased item is a service, this 14-day period starts from the date the contract is signed. The right of withdrawal cannot be exercised in service contracts where the performance of the service began with the consumer's consent before the right of withdrawal period expired. The Buyer has been informed about the right of withdrawal in the Distance Contracts and Cancellation Conditions, and the Buyer places the order knowing the conditions for withdrawal.

14. The expenses arising from the exercise of the right of withdrawal belong to the SELLER.

15. To exercise the right of withdrawal, it is mandatory to notify the SELLER in writing or by the relevant method, via registered mail with return receipt, fax, email, or a method specified by the SELLER, within 14 (fourteen) days, and for the product not to have been used within the scope of the "Products for which the Right of Withdrawal Cannot Be Used" provisions regulated in this contract.

EXERCISE OF THE RIGHT OF WITHDRAWAL:

16. The invoice of the product delivered to the 3rd party or the BUYER, (If the invoice of the product to be returned is corporate, it must be sent with the return invoice issued by the institution. Order returns invoiced to institutions cannot be completed unless a RETURN INVOICE is issued.)

17. The return form, the box, packaging, and any standard accessories of the products to be returned must be delivered complete and undamaged.

RETURN CONDITIONS:

18. The SELLER is obliged to refund the total amount and the documents that put the BUYER under debt within 10 days at the latest from the receipt of the withdrawal notification, and to take back the goods within 20 days.

19. If there is a decrease in the value of the goods due to a fault of the BUYER or if the return becomes impossible, the BUYER is obliged to compensate the SELLER for damages in proportion to their fault. However, the BUYER is not responsible for changes and deteriorations that occur due to proper use of the goods or product within the period of the right of withdrawal.

20. If the campaign limit amount determined by the SELLER is fallen below due to the exercise of the right of withdrawal, the discount amount benefited from within the scope of the campaign is canceled.

PRODUCTS FOR WHICH THE RIGHT OF WITHDRAWAL CANNOT BE USED:

21. Products prepared in line with the BUYER's wishes or explicit personal needs and not suitable for return, lower parts of underwear, swimwear and bikini bottoms, make-up products, disposable products, products that are likely to spoil quickly or have an expired use-by date, products whose packaging has been opened by the BUYER after delivery and are not suitable for return due to health and hygiene reasons (earrings), products that mix with other products after delivery and cannot be separated by nature, goods related to periodicals such as newspapers and magazines, except those provided under a subscription contract, services performed instantly in electronic environment or intangible goods delivered instantly to the consumer, and audio or video recordings, books, digital content, software programs, data recording and data storage devices, computer consumables, are not allowed to be returned if their packaging has been opened by the BUYER, according to the Regulation. Furthermore, exercising the right of withdrawal for services whose performance has begun with the consumer's consent before the right of withdrawal period expires is also not possible according to the Regulation.

22. For cosmetic and personal care products, underwear, swimwear, bikinis, books, copyable software and programs, DVDs, VCDs, CDs and cassettes, and stationery consumables (toner, cartridge, ribbon, etc.) to be returnable, their packaging must be unopened, untried, undamaged, and unused.

23. According to the following distance sales regulation; products for which the right of withdrawal cannot be used:

  • Contracts relating to goods prepared in accordance with the consumer's wishes or personal needs.

  • Contracts relating to the delivery of goods that are likely to spoil quickly or have an expired use-by date.

  • Contracts relating to the delivery of goods whose protective elements such as packaging, tape, seal, or package have been opened after delivery and are not suitable for return due to health and hygiene reasons.

  • Contracts relating to goods that mix with other products after delivery and cannot be separated by nature.

  • Contracts relating to books, digital content, and computer consumables presented in a tangible medium, if their protective elements such as packaging, tape, seal, or package have been opened after delivery.

  • Contracts relating to accommodation, goods transport, car rental, food and beverage supply, and leisure activities for entertainment or recreation that must be performed on a specific date or period.

  • Contracts relating to services performed instantly in an electronic environment or intangible goods delivered instantly to the consumer.

DEFAULT AND LEGAL CONSEQUENCES

24. If the BUYER defaults when making payments by credit card, they accept, declare, and undertake to pay interest within the framework of the credit card agreement with the cardholder bank and to be responsible to the bank. In this case, the relevant bank may resort to legal remedies; it may demand any resulting expenses and attorney's fees from the BUYER, and in any event that the BUYER defaults on their debt, the BUYER agrees to pay the loss and damage incurred by the SELLER due to the delayed performance of the debt.
